Off duty construction foreman’s accident on work site, confidential settlement

A construction worker and his foreman had been drinking heavily at a Rochester night club. The foreman would check on the progress at the Highway 52 construction project, which ran 24/7. Our client met her boyfriend, the construction worker, at the nightclub and all three were going to leave to go to a party together. On the way to the party, the foreman decided to stop at the job site to talk to crew members working the night shift. When leaving the job site, he drove through a closed section of the Highway.

He was driving too fast, lost control of the truck and it rolled over and down an embankment. The driver was killed in the collision and our client received serious, permanent injuries. Paul Downes, working with an attorney from Rochester, successfully argued that the foreman was within the course and scope of his employment when the accident happened, and therefore, his employer was held responsible for the injuries to our client. The case was settled for a significant amount but at the request of the defendant, the amount is confidential.
