DEFECTIVE HIP REPLACEMENT RECALL

Know Your Rights: Important Information concerning the DePuy Hip Replacement Recall & Lawsuits

On August 26, 2010, DePuy Orthopaedics (a company owned by Johnson & Johnson) recalled 93,000 hip replacement units. The recalled units are the ASR Acetabular System and the ASR Hip Resurfacing System. One in eight patients who received these devices has required a second surgery to remove and replace the devices.

If you had a hip replacement performed after July 2003, there is a chance you had a defective device implanted in you. You may be entitled to compensation. Please contact Susan Holden (phone: 612-333-9755, or email: susan.holden@knowyourrights.com) or Paul Downes, (phone: 612-333-9774, or email: paul.downes@knowyourrights.com) the most experienced products liability and medical device lawyers at Sieben, Grose, Von Holtum & Carey, for more information.

We’ve also designed this page to answer questions you may have concerning the DePuy hip recall.

What are the dangers of the recalled hip replacement devices?

Due to a faulty design of metal-on-metal moving parts, both of these units have the ability to shed into the recipient’s body toxic metal fragments that can produce serious side effects such as bone fractures around the implant, joint dislocation, pain in walking and rising up from a chair, swelling and even tumors.

How do I find out if I’m affected by the DePuy recall?

You need to talk to your doctor.

Johnson & Johnson does not know which patients received the defective devices, so they will not be contacting you. All the company can do is to inform doctors and the public at large about the recall.

The doctor who performed your hip replacement surgery may call you if you have a recalled device, but it is a good idea for you to be proactive. We suggest you contact the doctor who performed your implant or the hospital where the surgery was performed to see if you have a recalled device.

If my hip feels okay, do I need to do anything?

Yes! Even if you feel no pain, it is important to see your doctor. The doctor will test your blood to see if it contains microscopic metal fragments from the device. If fragments are found, this indicates the device is failing, putting you at risk of injury in the future. In this case, your doctor may determine that a second surgery is necessary to remove and replace the device.

DePuy has promised to pay for the surgery to remove and replace my hip replacement device, so why would I need a lawyer?

On its website, DePuy (who is owned by Johnson & Johnson) says it “intends to pay reasonable and customary costs of testing and treatment” required by the recall. What a large company considers to be "reasonable" and "customary" remains to be seen. Can you, the patient who has had to endure the risks, pain and recovery of a second surgery, trust the words of a company who has had 11 product recalls since September of 2009?

If you have received documents from DePuy, please contact Susan Holden (phone: 612-333-9755, or email: susan.holden@knowyourrights.com) or Paul Downes, (phone: 612-333-9774, or email: paul.downes@knowyourrights.com) for a free, no obligation consultation with a personal injury lawyer experienced in handling defective hip implant cases.
