The defendants asked our client to come to their home while they were gone to wait for Federal Express to deliver a computer. When our client arrived at their house, she entered by using the keypad on their garage door then entered through the basement. As she was walking up the stairs from the basement, she heard the defendant's black lab named Daisy barking. Daisy was standing at the top of the stairs barking and our client was frightened. The dog lunged at our client and caused her to fall backwards down the stairs. Our client was bleeding but was able to call 911 from her cell phone for assistance. As a result of her fall, our client suffered an "accident stroke", caused from blunt force trauma to the head, not from a blood clot. Initially her entire left side was paralyzed. She spent 10 days in the hospital then was discharged for extensive therapy. Due to her injuries, she moved into an assisted living facility where she is expected to stay for the rest of her life.
Harry Sieben filed suit against the dog's owners and their homeowners' insurance and obtained a settlement in the amount of $300,000 for our client.
