Our client and his wife were riding their motorcycles on Minnesota Trunk Highway 316; our client was lead motorcycle and his wife was riding behind him.  They had just gone by the turnoff for Prairie Island Casino and our client was in the curve beyond that turn when he met 5-6 cars going the opposite direction.  The 3rd car in that line of vehicles drifted over into his lane and he went to the right to avoid that vehicle, but it struck the side of his motorcycle with the driver’s door area.  The driver that struck him continued on and didn’t stop.  His wife stopped and the two people in the car right behind her stopped and asked what happened.  She said that her husband had been hit by a car that kept on going.  The people in that vehicle then turned around and found the vehicle that had struck our client a short distance down the road where the driver was trying to change a flat tire that it had sustained in the accident.  The police then arrived at the scene and arrested the driver, who was intoxicated at the time of the accident.

Our client’s left leg was amputated below the knee due to the injuries he sustained in the accident. He also sustained tendon damage on his left hand and had road rash on his side.  The doctors tried to save his leg, but eventually decided it was too badly damaged to do so.  Our client was a service technician for a cable company and was not able to return to that line of work.

Jim Carey filed a lawsuit against the insurance company for the car that hit our client and in less that 4 months, settled that claim for the full policy limits, $1,250,000.  He continues to pursue claims against the underinsured policy of our client’s motorcycle insurance.
