Our client, an eight year old boy, was seriously injured while riding up an escalator at a department store. The boy was riding with his mother and sister on the escalator when the boy’s foot became caught between two steps near the top. He was unable to pull his foot free before it reached the top platform where his foot was forced into the comb plate. The escalator continued to run until someone shut it off. In this process the boy suffered serious crush damage to his foot. Several toes were amputated and he lost substantial tissue from the bottom of his foot.

Claims were litigated against the companies that manufactured and maintained the escalator as well as the department store owner whose employees inspected the operation of the escalator each day. We learned through expert analysis that the escalator had design defects as well as inadequate maintenance which lead to other similar incidents involving this escalator before this boy’s injury.

This boy received substantial medical treatment for his injury including skin grafts and reconstruction of his foot. He had lifelong disfigurement and disability to the foot and would require additional medical treatment into the future.
