Our client was heading southbound on a four-lane highway. The defendant was northbound in the left turn lane on Highway 63 waiting to turn westbound. There was an SUV was stopped in the southbound left turn lane of Highway 63; at least four vehicles were stopped behind the SUV. These vehicles were waiting for traffic to clear so they could turn .
There were approximately four car lengths between our client and the next car in front of him. As our client entered the intersection on a green light, the Defendant also entered the intersection to make a left turn. Our client hit the brakes, but the front right corner of his truck struck the right rear corner of the defendant’s vehicle. The Defendant’s vehicle rotated approximately 90 degrees upon impact. The defendant is cited for failure to yield right of way.
Our client was diagnosed with a left hip strain after the accident. Because the hip pain did not improve, he continued to see doctors and was eventually referred to the Mayo Clinic. The doctor there performed a hip resurfacing surgery. However, the defendant contended that the hip injury was the result of a prior accident and injury to the same hip. We were able to show that the injury was, in fact, a substantial aggravation of a pre-existing condition.
Jeff Montpetit settled his claim against the other driver for $90,000.
