Our client installed automobile windshields for over 18 years. He would replace 6-8 windshields a day. To do this, he would press the top of his head against the front windshield and hold that position for approximately 10 minutes while he cut the rubber around the bottom of the windshield. After years of this work, the pressure put on his head, neck and spinal column caused a neck injury. He had a hemorrhaged disc in his neck and a bruised spinal cord.

He filed a WC claim in 1992 and received some workers’ compensation benefits. However, by 2007 his condition had worsened so that he was in constant pain and unable to work at all. The insurance carrier contended that he was not permanently and totally disabled.

He wasn't sure if he would still be entitled to benefits so he contacted Bonnie Peterson. She pursued a claim against the insurance company for permanent total disability benefits and retraining benefits. Bonnie reached a settlement at mediation for our client in the amount of $325,000.

Our client was entitled to these benefits because his injury occurred prior to the severe cut in benefits in the 1992 and 1995 amendments to the workers’ compensation laws.
