A 15 year old student was enrolled in driver’s education classes. She and a friend went to McDonalds before their class and as they were crossing the 4 lane highway that did not have a crosswalk, one of the girls was struck by a vehicle. The girls had waited for traffic to clear before they started crossing the road. The defendant driver was in the right lane and changed into the left lane and sped up and struck the girl as she was crossing. He told police that he had looked down at his speedometer and didn’t see the pedestrian crossing. She died a few hours after the accident at the hospital. Harry Sieben represented the girl’s parents in a claim against the at fault driver and their own underinsured motorist coverage. He settled for the policy limits with both insurance companies.
