I remember when Harry Sieben and SiebenCarey were on WCCO Point of Law. So when a family member needed a car accident attorney, I told them to go with the “Know Your Rights” attorneys. There’s a reason they keep winning awards for Best Law Firm, Best Lawyers, and Super Lawyers. They do a great job -- and they're fantastic community supporters.

We understand how insurance companies handle these claims, and we know what it takes to establish liability and pursue fair compensation. Now we’re ready to help you too.

How Our Duluth Slip and Fall Lawyers Can Help You

After a serious fall, you likely have pressing questions. Who is responsible for the accident? What rights do you have? What compensation are you owed? What should you do next?

At SiebenCarey, our Duluth slip and fall lawyers can answer those questions and guide you through the legal process. We'll investigate the circumstances of your accident, determine who may be responsible, and build a case for the compensation you deserve. Our team will:

  • Investigate your accident: Our attorneys will gather photographs, surveillance footage, witness statements, and other evidence to establish what happened.
  • Identify responsible parties: We’ll find out whether a property owner, business, maintenance company, or another party may be liable for your injuries.
  • Document your losses: We will use medical records, employment information, and other documentation to establish the full impact of your injuries and calculate your damages.
  • Handle insurance companies: Our team manages all communications with insurers so you don’t have to deal with claims adjusters and insurance attorneys trying to minimize your claim.
  • Represent you in court: If the insurance company refuses to offer a fair settlement, our attorneys are ready to fight for your rights at trial.
  • Update you regularly: We will keep you informed throughout the process and answer all your questions so you never have to wonder what’s next.

From start to finish, we will handle every aspect of your claim so you can rest and focus on healing.

2. Comprehensive Investigation

ATV accidents often happen on remote trails with no traffic cameras and few witnesses. We’ll send our investigators to collect any evidence they can. We will also investigate the ATV itself for mechanical issues that may have contributed to your accident. Our job is to identify who's responsible for your accident and prove your claims.

3. Medical Documentation

We will work closely with your doctors to make sure every diagnosis, procedure, and prognosis is properly documented from day one. That way, we can prove how serious your injuries are and show that you took the right steps to treat your condition. If your injuries are expected to affect you long-term, we’ll seek compensation for all future damages as well.

4. Insurance Negotiations

We will handle all communications with your insurance company on your behalf. Insurance adjusters are trained to get people to accept less than they deserve. We will use evidence to support your claims and fight for fair compensation.

5. Trial Preparation

Most personal injury claims settle before trial, but we prepare every Duluth ATV case as though it's headed to court anyway. Insurance companies pay closer attention to claimants who are genuinely ready to go the distance. That preparation is often what convinces an insurer to offer a fair settlement instead of risking a trial.

Get started on your case today.

Call our Duluth office at 218-722-6848 for a free consultation about your ATV accident.

Common Causes of Slip, Trip, and Fall Accidents in Duluth

Falls can occur almost anywhere, from restaurants and retail stores to apartment buildings, sidewalks, and private homes. Many are caused by hazardous conditions that property owners or other responsible parties could have identified and addressed already.

  • Ice and Snow

Duluth's long winters can turn sidewalks, stairs, parking lots, and building entrances into slipping hazards. Packed snow, freezing rain, and melting snow that refreezes overnight all make the area more dangerous. Improper drainage can lead to recurring ice buildup, and poorly performed snow removal can leave behind slick surfaces or piles of snow that melt and refreeze. These hazards can be especially difficult to spot when fresh snow covers existing ice.

  • Wet or Slippery Floors

Spilled liquids, recently mopped floors, leaking refrigeration equipment, and water tracked inside can all create slippery surfaces. These hazards are especially common near building entrances, in grocery store aisles, and in other areas where moisture accumulates.

  • Uneven Walkways

Cracked pavement, raised sidewalk sections, potholes, and damaged concrete can trip pedestrians going about their business. Uneven surfaces become especially dangerous when poor lighting or gathered snow makes them difficult to see.

  • Dangerous Stairs and Floors

Stairs with broken steps and missing handrails often lead to falls. These falls can be particularly dangerous because victims may tumble down multiple steps or strike hard surfaces.

  • Poor Lighting

Dim stairwells, dark parking lots, and poorly illuminated walkways can keep pedestrians from seeing obstacles or wet surfaces. In poor lighting, even familiar walking routes can become dangerous.

  • Cluttered Walkways

Loose carpet, electrical cords, merchandise left in aisles, unsecured floor mats, construction materials, and other obstacles are all tripping hazards. When not cleaned up or moved out of the way, these mundane inconveniences can injure anyone passing by.

Who Can Be Held Liable for a Slip and Fall Accident in Minnesota?

Minnesota premises liability law requires property owners to take reasonable steps to keep their property safe for lawful visitors. When a property owner fails to meet that duty, they can be held responsible for any injuries their negligence causes. This may include:

  • Business owners: Stores, restaurants, hotels, and other businesses may be liable for injuries caused by dangerous conditions on their premises.
  • Commercial property owners: Shopping centers, office buildings, and other commercial properties may have unsafe walkways, parking lots, stairs, or entrances.
  • Landlords and property managers: The parties responsible for apartment buildings and rental properties may be liable for dangerous conditions in common areas or other areas under their control.
  • Homeowners: Homeowners may be liable when their negligence injures a guest.
  • Maintenance contractors: Companies responsible for cleaning, repairs, snow removal, or other maintenance may share responsibility when their negligent work contributes to an accident.
  • Government entities: Cities and other public entities may face liability for certain accidents on public property, although special legal protections and procedural requirements may apply.

In some cases, there may be multiple at-fault parties. For example, a shopping center owner may hire a property management company, which then contracts with a separate business for snow removal. If someone is injured in the shopping center, each of those parties may share the blame.

Our attorneys examine all the evidence, from surveillance footage to maintenance agreements, to determine which parties may bear responsibility for your injuries.

Don’t let negligent property owners evade accountability.

Our Duluth slip and fall lawyers will investigate your accident, identify the responsible parties, and help you pursue the compensation you deserve. Claim your free consultation today.

What Compensation Can You Recover After a Slip and Fall Accident?

If another party's negligence caused your accident, you may be entitled to compensation for both your financial losses and the personal consequences of your injuries. That may include:

  • Medical expenses, such as emergency treatment, hospitalization, surgery, medications, and physical therapy
  • Future medical costs, covering the anticipated expenses for ongoing treatment, rehabilitation, assistive devices, or long-term care
  • Lost wages you’re missing out on while your injuries prevent you from working
  • Lost earning capacity if a permanent injury limits your ability to earn income in the future
  • Pain and suffering, including both physical pain and any psychological effects caused by your accident
  • Loss of enjoyment of life if your injuries impact your hobbies and other activities you previously enjoyed
  • Permanent disability or disfigurement

Our attorneys will evaluate the full impact of your injuries to pursue a recovery that accounts for your current needs and anticipated future losses.

What to Do After a Slip, Trip, or Fall Accident

The steps you take after a fall can affect both your recovery timeline and your legal options.

1 Step

Seek Medical Attention

After a fall accident, your health should always be your first priority. Even if you initially feel fine, you should still consider seeing a doctor as soon as you can, especially if you struck your head or lost consciousness. Some injuries may not have obvious symptoms right away, and adrenaline or stress could be masking the pain.

Seeing a doctor will also help document your accident and injuries if you file an injury claim later.

If your doctor gives you treatment recommendations, follow them carefully and attend all scheduled appointments.

2 Step

Report the Accident

Notify the property owner, manager, or another responsible person about your slip and fall accident as soon as possible. Provide an accurate account of what happened, but avoid speculating about the cause of the accident or the severity of your injuries. If you fell at a business, ask to complete an incident report and request a copy for your records.

3 Step

Document the Dangerous Condition

If you're able, take photographs and videos of the area where you fell. Focus on the hazard itself, the surrounding conditions, and any details that help explain the accident.

For example, if you slipped on ice, photograph the ice buildup, nearby drainage, and surrounding walkways. If you tripped over damaged flooring, document the defect before the property owner repairs it. These photographs can become particularly important when snow melts, spills are cleaned up, or other hazards disappear shortly after an accident.

4 Step

Collect Witness Information

If anyone saw your fall or noticed the dangerous condition beforehand, ask for their name and contact information. Independent witnesses can help establish what happened and whether the hazard existed before your accident.

5 Step

Preserve Record

Keep copies of any records related to your injury, including:

  • Medical bills
  • Treatment records
  • Prescription receipts
  • Documentation of missed work

Start a journal to record how your injuries affect your daily activities, including difficulties with walking, sleeping, household tasks, and recreational activities. These records can help establish the full extent of your losses.

6 Step

Speak With a Duluth Slip and Fall Lawyer

After an accident, you will likely be dealing with plenty of stress and pain. This can make it difficult to know what to do next. Talking to an attorney can help you protect your rights and avoid costly mistakes.

Before signing any documents or giving a recorded statement, speak to a Duluth slip, trip, and fall attorney to make sure you aren’t signing away your rights or saying more than you should. Above all, never sign an insurance settlement without legal advice. An early settlement may fail to account for additional medical treatment, lost income, or permanent limitations that become apparent later. In many cases, insurance claims adjusters will pressure you to accept a rushed lowball offer before you have a chance to find out what your claim is really worth.

Registration Requirements

Nearly every ATV operated in Minnesota must be registered with the DNR, even one that's only ever ridden on private property. The main exceptions are farm vehicles used strictly for agricultural work and ATVs 25 years or older, which can be registered as collector vehicles instead.

Safety Certification

Minnesota requires all riders born after July 1, 1987, to have an approved ATV safety certificate to ride on public land, trails, or frozen waters, or to cross a roadway. Riders can earn the certification starting at age 12.

Helmet Rules

Anyone under 18 must wear a DOT-approved helmet while riding on public land, public waters, or a public road right-of-way. There's no legal helmet requirement for adult riders, though the DNR recommends wearing one at any age.

Age Restrictions

Minnesota sets specific limits based on age and ATV class.

  • Children under 10 can only ride on private property, and only with the landowner's permission.
  • Children aged 10 and 11 can ride on public land, but only on a small ATV (90cc or under) and only with a parent or guardian present.
  • No rider under 15 can operate a larger Class 2 ATV under any circumstances.
  • Once a rider turns 15 and holds a valid safety certificate, they can also ride on the shoulder of certain public roads.

Alcohol Laws

Riding an ATV while impaired carries the same legal consequences as driving a car under the influence. Operating an ATV with a BAC of 0.08% or more is a crime. It is also one of the most common factors behind fatal ATV crashes statewide.

FAQs

How long do I have to file a slip and fall claim in Minnesota?

The statute of limitations for most Minnesota personal injury claims is six years from the date of the accident. However, the sooner you contact an attorney, the easier it will be for them to gather evidence and build a strong case.

What if I fell at a friend's or family member's house?

Pursuing compensation from a friend or family member generally does not harm their finances. Homeowners insurance often provides liability coverage for injuries caused by dangerous conditions on the property. This means you would be recovering compensation through their insurance policy rather than making them pay your expenses out of pocket.

Our attorneys can review the available insurance coverage, explain your options, and help you pursue compensation while being mindful of your relationship with the homeowner.

Can I file a claim if there were no witnesses to my fall?

Yes. Witness testimony can be valuable, but it isn't the only way to establish what happened. Photographs, surveillance footage, medical records, incident reports, and previous complaints or maintenance problems can help support your case.

Our attorneys will investigate the circumstances and identify available evidence even when no one directly witnessed the accident.

Can I file a slip and fall claim if I was injured at work?

A fall at work may qualify for workers' compensation benefits, which can cover medical expenses and certain lost wages. You may also have a separate personal injury claim if a negligent third party, such as an outside maintenance contractor or another company responsible for the property, caused your accident.
